1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Tung Blossom" / "We" / "Us": The residential home operated at 67 Tai Chung Kiu Road, Sha Tin, New Territories, Hong Kong
- "User" / "You": Any individual who accesses our website or submits an enquiry
- "Resident": An elderly individual who has been admitted to Tung Blossom under a residential agreement
- "Family": The family members or authorised representatives of a Resident or enquiring individual
- "Services": The residential care offerings described on our website, including Blossom Residence, Art & Expression Afternoons, and the Seasonal Three-Week Stay
- "Agreement": These Terms and Conditions together with any residential service agreement entered into between Tung Blossom and a Resident's family
2. Acceptance of Terms
By accessing this website or submitting an enquiry through our contact form, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or submit an enquiry.
All individuals using our services must be aged 18 or over, or acting with the capacity and authority to enter into a binding agreement on behalf of a Resident.
3. Description of Services
Tung Blossom provides non-medical residential care services for elderly people in Hong Kong. Our services are not a substitute for medical, nursing, or clinical care. We do not employ registered nurses, doctors, or clinical staff. Our team provides companionship, daily living support, and structured activities.
Current service offerings include:
- Blossom Residence: Full-time residential accommodation at HK$14,200 per month
- Art & Expression Afternoons: Twice-weekly creative programme at HK$1,680 per month
- Seasonal Three-Week Stay: Short-term residential stay at HK$9,800 for three weeks
We reserve the right to update service descriptions and pricing. Current pricing is always confirmed in writing prior to any service commencement.
4. Enquiries and Website Use
Use of our website is permitted for lawful purposes only. You must not misuse our website or contact form. By submitting an enquiry, you acknowledge that we will use your contact details solely to respond to your enquiry in accordance with our Privacy Policy.
We aim to respond to all website enquiries within two business days.
5. Residential Admission
Admission to any of our residential or programme services is subject to:
- A pre-admission conversation with the family and, where possible, the prospective Resident
- Assessment of whether our non-medical services are appropriate for the individual's needs
- Completion of a residential service agreement and any required documentation
- Payment of the applicable fees as detailed in the service agreement
Tung Blossom reserves the right to decline admission where our services are not suited to the individual's care requirements.
6. Payment Terms
All fees are quoted in Hong Kong Dollars (HKD). Payment is due as follows:
- Monthly fees (Blossom Residence and Art Afternoons) are payable in advance on the first day of each month
- Seasonal Stay fees are payable in full prior to the commencement of the stay
- Accepted payment methods will be confirmed at the time of service agreement
Fees are subject to annual review. Any changes to fees will be communicated to families with a minimum of one month's written notice.
7. Notice and Termination
Either party may terminate a residential service agreement by providing one calendar month's written notice. For the Seasonal Three-Week Stay, cancellations made more than 14 days prior to the start date will receive a full refund; cancellations within 14 days of the start date may be subject to a partial charge.
Tung Blossom may terminate a service agreement with immediate effect if the Resident's care needs exceed what our non-medical services can appropriately support. In such circumstances, we will work with the family to identify a more suitable arrangement.
8. Responsibility and Disclaimers
Tung Blossom provides non-medical residential care. We do not provide and cannot be held responsible for medical diagnosis, clinical assessment, or medical treatment. We strongly encourage families to ensure that Residents have access to their own medical practitioners for any health concerns.
We take reasonable care to provide a safe and comfortable environment. However, we cannot accept responsibility for accidents or incidents that are not caused by our negligence.
Our website is provided for general information purposes. While we take care to keep information accurate, we do not warrant that all content is complete, current, or free of error.
9. Intellectual Property
All content on this website, including text, images, and design elements, is the property of Tung Blossom or used with permission. You may not reproduce, distribute, or use any content from this website without our prior written consent.
10. Limitation of Liability
To the fullest extent permitted by Hong Kong law, Tung Blossom's liability in connection with the use of this website or our services is limited to the amount paid for the specific service in question during the period giving rise to the claim. We exclude liability for indirect, consequential, or incidental loss.
11. Indemnification
You agree to indemnify Tung Blossom against any claims, losses, or costs arising from your breach of these Terms and Conditions or your misuse of our website or services.
12. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
We encourage any concerns to be raised with us directly in the first instance. Most issues can be resolved through open conversation.
13. General Provisions
- If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force
- Our failure to enforce any provision does not constitute a waiver of that provision
- These Terms, together with any signed service agreement, constitute the entire agreement between the parties in relation to our services
14. Changes to These Terms
We may update these Terms and Conditions from time to time. Any material changes will be reflected in the "Last updated" date above. Continued use of the website following any update constitutes acceptance of the revised terms.
